Aguilar, who played at Diablo Valley, Appalachian State and Tennessee, argued that seasons spent at junior colleges should not count against his Division I eligibility. He had a preliminary injunction hearing in Knox County Chancery Court after the court granted a temporary restraining order last week.
The judge, concerned about national implications, will decide whether Aguilar can return to the Volunteers. Even if cleared, he cannot play immediately as he is still recovering from a shoulder tumor removal.
